Kitsu Coffee Client Portal — Terms of Use
Version 2026-10-v1 · In force from its publication on this page.
These terms apply to businesses that use the Kitsu Coffee client portal. Our terms of sale (minimum order, prices, payment) are on a separate page.
Article 1 (Purpose) These Terms set out the rights and duties between KITSU COFFEE S.A.S., a company incorporated in Colombia (NIT 902.113.014-0, domiciled in Bogotá, Colombia; contact: Kitsucoffee@outlook.com) ("Kitsu", "we"), and the users of the Kitsu Coffee client portal (the "Portal"), through which business customers request quotes, place and follow orders of green coffee, and exchange messages and documents with Kitsu.
Article 2 (Definitions)
1. "Portal": the signed-in area of kitsucoffee.com operated by Kitsu.
2. "User": anyone who uses the Portal, whether Member or Applicant.
3. "Applicant": a person who has submitted an application on behalf of a business and is waiting for Kitsu's decision.
4. "Member": an Applicant whose application Kitsu has approved.
5. "Account": the Member's access to the Portal, opened with an email address and a password, or with any other sign-in method that Kitsu offers in the Portal.
Article 3 (Business use only; publication and changes of these Terms)
1. The Portal is offered only to businesses (roasters, cafés, importers, distributors and other professional buyers) acting for business purposes. It is not offered to consumers. By applying you confirm that you act on behalf of a business, or as a self-employed professional, and that you are authorised to do so. You must be of legal age under the law that applies to you.
2. Kitsu shows these Terms in the Portal, where they can be read and printed at any time.
3. We announce changes in the Portal or by email at least 7 days before they take effect, or 30 days before if a change is unfavourable to Members, stating what changes and from when. A Member who does not agree may close the Account before the change takes effect.
Article 4 (Services and changes) The Portal offers: the catalogue with reference prices, quote requests, order and shipment tracking, documents, payment information and messages. Kitsu may change the services for operational or technical reasons and will announce significant changes in advance.
Article 5 (Interruption of the service) Kitsu may pause the Portal for maintenance, failures of equipment or communications, or outages of third-party services (such as sign-in providers or hosting). Planned pauses are announced in advance when possible.
Article 6 (Membership: application and formation of the Account)
1. To apply, the Applicant signs in, accepts the required items and completes the profile form.
2. The Account is formed only when Kitsu approves the application and tells the Applicant. Signing in does not, by itself, create an Account or give access to quotes, orders or documents.
3. Kitsu may decline an application, in particular when: (1) the information is false, incomplete or belongs to someone else; (2) the Applicant is not a business or is outside the scope of the Portal; (3) the business cannot be identified from the information given; (4) the Applicant's account was previously suspended or closed by Kitsu; (5) Kitsu cannot reasonably verify the business; (6) the supply would breach applicable law, sanctions or export rules; (7) Kitsu does not serve the Applicant's country or volume; (8) there is a technical impediment. Kitsu tells the Applicant its decision and, where the law requires it, the reasons.
4. While the application is pending, the Applicant can only see and edit their own information, or withdraw the application.
Article 7 (Closing the Account; suspension and loss of membership)
1. A Member may close the Account at any time from the Portal or by email, as explained on the page "Delete your account" (kitsucoffee.com/delete-account). Obligations of orders already placed continue.
2. Kitsu may restrict or suspend an Account if the Member: (1) gave false information; (2) fails to pay amounts due; (3) tries to access data of others or to bypass the Portal's security; (4) uses the Portal against the law or these Terms; (5) shares or resells access; (6) behaves abusively towards Kitsu staff.
3. If the cause is not corrected, Kitsu may end the membership after telling the Member at least 30 days before and giving them a chance to explain, except in urgent cases (for example a security risk or a legal order).
Article 8 (Notices to Members) Kitsu sends notices to the email address in the Member's profile. Notices that concern all Members may be shown in the Portal for at least 7 days instead.
Article 9 (Quotes and formation of each order) A quote is valid until the date shown on it. A contract for an order is formed when the Member accepts a quote in the Portal and Kitsu confirms the order. Minimum quantities, prices (in USD, before taxes), delivery terms and Incoterms are those shown in each quote. If a quote and these Terms differ, the quote prevails.
Article 10 (Payment) Payment follows the proforma invoice and the methods shown in the Portal. A payment report by the Member is not a confirmation until Kitsu confirms it.
Article 11 (Shipping, import and documents) Unless the quote says otherwise, the Member is responsible for import permits, duties, taxes and food-safety registrations in the destination country. Kitsu provides the shipping and export documents listed in the quote.
Article 12 (Quality and claims) Green coffee is an agricultural product and varies naturally. Claims must be sent with evidence, promptly after arrival and within any period agreed for the order. The remedy (replacement, credit or other) is agreed case by case.
Article 13 (Personal data) Kitsu collects only the data needed for the Portal and handles it as described in the Privacy Policy (kitsucoffee.com/privacy).
Article 14 (Kitsu's obligations) Kitsu operates the Portal with reasonable care, protects Users' data with appropriate security measures, and does not send advertising emails to Users who have not agreed to receive them.
Article 15 (Sign-in details) Members are responsible for their sign-in details (password, or the account of any other sign-in method they use). They must not let others use them and must tell Kitsu at once if they suspect misuse. Kitsu will never ask for your password.
Article 16 (User obligations) Users must not: give false information; use another person's data; try to bypass the Portal's security or access other Users' data; collect data from the Portal automatically; interfere with its operation; or use it against the law.
Article 17 (External links) The Portal may link to other websites (for example carriers' tracking pages). Kitsu is not responsible for those websites or for transactions made on them.
Article 18 (Intellectual property) Texts, images and brands in the Portal belong to Kitsu or its licensors and may not be reused without permission.
Article 19 (Resolving disputes) Kitsu will first try to resolve any complaint by talking with the Member. Contact: Kitsucoffee@outlook.com. Nothing in these Terms limits any liability that cannot be limited under the applicable law.
Article 20 (Governing law and jurisdiction) These Terms are governed by the law that applies under the rules of private international law, and disputes are decided by the courts that are competent under that law. Nothing in these Terms takes away the protection that mandatory rules of your country give you.
